Whistleblowing Training

Educating your staff is an important part of reducing your organisation’s legal risk in relation to whistleblowing. We have extensive experience in training diverse groups of people and have developed a range of easily customisable training courses for each of the following audiences:

  • Employees
  • Eligible Recipients (including senior managers and executives)
  • Directors
  • Whistleblowing program staff

Training sessions range from 15 minutes (for a basic Board update) to a 3-hour intensive workshop for whistleblowing program staff. Contact us to arrange an in-person or an online training session to educate your staff in an accessible, easy to understand manner by an expert in whistleblowing law.

Whistleblowing Law Advice

Whether you have a formal whistleblowing program or not, all corporations are required to comply with the whistleblower protections in the Corporations Act. Penalties for non-compliance are severe.

If you have a policy and program in place, we can help keep you on the right track by providing specialist advice on whistleblowing disclosures, including whether a particular disclosure is legally protected or not, and how to avoid breaching confidentiality. Disclosures can occur together with other employment law issues and deciding on the appropriate course of conduct can be tricky. Our expert advice will help you avoid legal liability, resolve disputes and achieve your strategic aims.

Legal Support for Recipients

Directors, officers and senior managers of a company have individual liability if they breach the strict rules relating to confidentiality of whistleblowing disclosures. Your organisation could also be liable if an eligible recipient mis-handles a disclosure. You can support your eligible recipients (and protect your organisation) by providing them with access to our independent legal support. We can help recipients understand how to:

  • Decide whether a disclosure is “protected” or not;
  • Obtain consent from a whistleblower;
  • Redact identifying information; and
  • Safely pass the disclosure to the whistleblowing program.

Whistleblowing Policy and Processes

When was the last time you reviewed your whistleblowing policy? Does your policy fit your organisation’s culture and values, or does it need a refresh?

Large private companies and all public companies are mandatorily required to have a whistleblower policy. Implementing a robust policy can also help to protect your organisation against claims of victimisation. We can help with:

  • Drafting and reviewing whistleblower policies to ensure compliance with applicable law and regulatory guidance;
  • Strategic approaches to reduce legal risk to the company;
  • Preparing disclosure handling guides for whistleblower protection officers;
  • Drafting guidelines for your disclosure committee; and
  • Preparing employee communications when implementing a new policy.
